Nobody has ever said what he is doing is against the rules.
But that statement basically backs up what I'm saying. Harden is aware that contact on the arms is going to draw a foul regardless of who initiates it. He has found a loophole and smartly is taking advantage of it.

I have no ill will towards Harden anymore. I enjoy watching him play. What I'm doing is telling you something that is actually happening on the floor though that I do not care for.

a. A common personal foul is illegal physical contact which occurs with an opponent after the ball has become live.
So how would you define physical contact? Does the defensive player have to initiate that contact? The NBA is now allowing players to stay straight up and defend the basket without calling a foul on them even though the offensive player is initiating the contact. So basically that is saying that the defender is not trying to foul the opponent but the offensive player is initiating the contact. This is basically the same thing when Harden drives the ball.
d. An offensive foul is illegal contact, committed by an offensive player, after the ball is live.
I think this is closer to an offensive foul than a defensive foul. Now of course I don't think either should be called but Harden is geting the benefit of an interpretation of the rule that I think the NBA is going to look at moving forward.

a. A dribbler shall not (1) charge into an opponent who has established a legal guarding position, or (2) attempt to dribble between two opponents, or (3) attempt to dribble between an opponent and a boundary, where sufficient space is not available for illegal contact to be avoided.
