    As well you should, as well we all should, but tell me the difference between this piece of utter nonsense and the absolute crap we hear from both of our main political parties? Remember the campaign? You ask them what day it is and they tell you all about the importance of the calendar to American History, and probably how they or their party was instrumental in its invention.

    I don't think it'd be unanimous, but it honestly wouldn't shock me to see it go as far as 6-2 or even 7-1. Could see Thomas being the only holdout.

    Edit: I think 5-3 might be the more likely result. I'm guessing Alito and Thomas, with maybe Roberts as well. I think Kennedy goes in favor of upholding the decision.

    I tend to think that they'll re-draft the EO and quietly drop the appeal. Of course, that would be a very non-Trumpian move, so maybe my common-sense compass is still not calibrated to this WH.

    If the federal government opts to go to the Supreme Court to reinstate the executive order, its request will go to Justice Anthony Kennedy, who oversees emergency appeals from the geographic region that includes the state of Washington. Once he receives it, Kennedy could either act on the request alone or (as is more likely) refer it to the full Supreme Court; he can (and probably will) also give the states an opportunity to file a brief opposing a stay. To block the lower court’s ruling and restore the ban, the government would need the votes of at least five of the eight justices. If the government can’t get those votes, which could be difficult given the temporary and relatively narrow nature of the court’s ruling, the ban could remain on hold while its full merits are litigated in the lower courts.

    The Trump administration will face another challenge if it opts to go to the Supreme Court: Its Supreme Court team will be operating short-handed. Trump has not yet nominated a new solicitor general, and the acting solicitor general – Noel Francisco, a political appointee – did not appear on the government’s reply brief in the 9th Circuit because his former law firm filed a “friend of the court” brief supporting Washington and Minnesota. Deputy Solicitor General Edwin Kneedler, a career lawyer in the Department of Justice, signed the brief instead, and another career Department of Justice lawyer, August Flentje, argued the case in the 9th Circuit.

    They'd almost certainly have to win in the lower courts, unless it took so long that Gorsuch both was confirmed and sided with Trump. Kagan, Sotomayor, RBG and Breyer sure as **** aren't going to side with him.

    It seems like it's close enough.

    Donald Trump has hinted that a new travel ban could be in the works, hours after his initial executive order was ruled unlawful by an appeals court.

    Mr Trump said on Friday, during a press conference with Shinzo Abe, the Japanese prime minister, that he will make a new policy announcement as soon as next week in response to a court ruling blocking his travel ban.

    "We'll be doing something very rapidly having to do with additional security for our country," he said.

    "You’ll see something next week.”
