Arizona’s top prosecutor is ramping up a criminal investigation into alleged attempts by Republicans to overturn the 2020 presidential election results in the state by signing and transmitting paperwork falsely declaring Donald Trump the winner, according to two people familiar with the investigation.

Arizona Attorney General Kris Mayes (D) assigned a team of prosecutors to the case in May, and investigators have contacted many of the pro-Trump electors and their lawyers, according to the two people who spoke on the condition of anonymity to candidly describe the probe. Investigators have requested records and other information from local officials who administered the 2020 election, the two people said, and a prosecutor has inquired about evidence collected by the Justice Department and an Atlanta-area prosecutor for similar probes.

It is unclear if the investigation will broaden into other attempts to undermine President Biden’s victory in the state, including a pressure campaign by Trump and his allies to thwart the will of voters and remain in office.

An Arizona grand jury on Wednesday indicted seven attorneys and aides affiliated with Donald Trump’s 2020 presidential campaign as well as 11 Arizona Republicans on felony charges related to their alleged efforts to subvert Joe Biden’s 2020 victory in the state, according to an announcement by the state attorney general.

Those indicted include former Trump White House chief of staff Mark Meadows, attorneys Rudy Giuliani, Jenna Ellis, John Eastman and Christina Bobb, top campaign adviser Boris Epshteyn and former campaign aide Mike Roman. They are accused of allegedly aiding an unsuccessful strategy to award the state’s electoral votes to Trump instead of Biden after the 2020 election. Also charged are the Republicans who signed paperwork on Dec. 14, 2020, that falsely purported Trump was the rightful winner, including former state party chair Kelli Ward, state Sens. Jake Hoffman and Anthony Kern, and Tyler Bowyer, a GOP national committeeman and chief operating officer of Turning Point Action, the campaign arm of the pro-Trump conservative group Turning Point USA.

Trump was not charged, but he is described in the indictment as an unindicted co-conspirator.

Many of those involved in the 2020 elector strategy, which played out in Arizona and six other states, have long insisted that the tactic was legal because the Trump electors were only placeholders to be activated if legal challenges to Biden’s win were successful in court. But Mayes charges that Trump’s allies inside and outside of Arizona intended all along to use the electors to falsely claim that the outcome of the election was in doubt — facilitating an effort to obstruct the certification of Biden’s victory in Congress on Jan. 6, 2021.

The false electors in a couple states included in their documents an acknowledgement that they were NOT in fact electors but were filing as place holders in the event of a finding that the election results were invalid. Those people haven't been charged and never will be.

There is a difference between filing a document claiming to be an elector as opposed to a place holder in the event the election results were invalidated. The courts will sort out the exposure to criminal law.

What question? Theres no question filling false electoral certificates stating you are the duly elected electors of a state is fraud and a crime. Saying you are the electors if the results are overturned via court order is not a crime.

it is novel in the sense no one has tried to do this before...as a matter of law it seems cut-and-dried...may not be viewed by the Supreme Court as something that it needs to weigh in on

When conservative lawyer and media personality Christina Bobb became one of the latest members of Donald Trump’s inner circle to be charged in connection with the effort to reverse the 2020 presidential election results, it became immediately clear she would not have to give up her day job: senior counsel to the Republican National Committee’s election integrity team.

For some, there is a certain irony — if not outright conflict — that a leading purveyor of false claims that the 2020 election was riddled with fraud is a major player in the national GOP’s efforts to protect the integrity of the 2024 vote.

But not for Bobb, and not for her closest allies — including Trump himself, who through a spokesman defended only Bobb by name among all the 18 individuals indicted Wednesday in Arizona. If anything, Bobb’s indictment solidifies her identity as a dedicated Trump loyalist who fiercely fought to reverse his loss in the politically competitive state and potentially elevates her role within the RNC to help him win in November.
