7-2 decision today allowing the WWI cross to stand. As predicted, the fact that it's an old war memorial played a big role.

Honestly, this was a bad case for the secular groups to take to the SCOTUS. The facts of the case didn't play well for them.

I'm gonna try to register Yankees Suck as a trademark. I like this decision.

The Supreme Court on Monday struck down the federal government’s ban on registering “immoral” and “scandalous” trademarks, saying it violates the First Amendment.

So the SCOTUS said the courts can't stop partisan gerrymandering and they said the citizenship question on the census is unconstitutional.

The gerrymandering decision is upsetting people but I think that's more because too many people want the SCOTUS to test laws based on whether they're good ideas or not.

Partisan gerrymandering presents problems and states should probably amend their constitutions to address drawing districts. However, making the courts responsible for ensuring completely fair districts in every way would be a huge power grab by the courts. It would effectively make the courts draw most every congressional map instead of the states. That would also be troubling.

Gerrymandering is a bad thing. But I agree with the decision. There has been a lot of judicial overreach over the years. It isn't the role of the courts to fix problems that our political system fails to. As it is a number of states have moved toward politically independent panels to do redistricting. Allow the political system to sort this out. As messy as that may be. Democracy is inherently messy.

This is a good example of a case that checks all the social issue boxes but legally has almost nothing to do with those issues.

This is a case actually about a parent's fundamental right to the rearing of their children and what process is required to overrule that right.

If this case was about a child wanting to make decisions about their cancer treatment, it's not news. However, the legal questions would be the same.

I’d like to see a top college or high school athlete challenge the validity of the draft. No college graduates (military graduates excluded) are told where they have to work for a few years and be forced to take a certain pay. They should be able to go to whatever team they want and they should be able to sign for any contract they are offered.

Since when is anyone forced to sign with MLB, NFL, or NBA? There are various other leagues they could sign with. Even beyond that you arent forced to play if you dont want to. Brett Devall chose to retire rather than have TJ surgery. Theres that Harrington kid that choose working at target over millions of dollars to play pro ball. Glavine could have gone play pro hockey instead of baseball too. So every player has options. Pretty sure service time and free agency and all that is a part of the CBA too. So they have a voice and leverage if they want to try and change the system.

I think the major sports leagues are exempt from the antitrust statutes that would be the basis for such a challenge. I haven't looked into the issue though.

Or that a consenting adult and employer who both want to work together, can't

A lot of these kids lose millions by not being able to engage in a consensual employment agreement right out of high school

I agree. I’m in favor of any measure that takes money and control from ownership and transfers it to the players.
