What FDR did wasn't illegal. And he wasn't the first one to try. With Cleveland, Grant, and Wilson all wanted to go for a 3rd term but didn't get nominated, and Teddy Roosevelt ran for a 3rd term and lost. And it wasn't like FDR ran for his 3rd and 4th term during the biggest war the world has ever seen or anything.
