Post-racial America, AMIRITE?

Curious why anyone would take a plea bargain if they were not guilty. I'd like to know the facts of the case before making a judgement.

Innocent people taking plea bargains are a pretty big issue in America right now. I don't know how you feel about John oliver, but this piece he did on public defenders outlines the issue fairly well:

It is actually extremely common because prosecutors use the threat of pushing for maximum punishment to pressure the victims into accepting plea deals. You might recall the case of Brian Banks who was a HS player with college scholarships and potential to play in the NFL who accepted a 5 year plea bargain for a rape he didnt commit because he faced a potential life sentence if he went to trial and lost. There have been several cases in the news in recent years of chemists in state labs falsifying tests sent to their lab. One cunt who did this actually got out of prison before one of her victims who was falsely convicted because of her got released.

Here is a story I posted a while ago that goes into the issue of innocent people accepting plea deals. I dont know if you have ever been in jail thethe but its literally torture. I am sure it gets easier over time but I have never spent more than 36 hours in jail so I wouldnt know. Now imagine you go before a judge and your options are accept a plea deal for something like 30 days which you have already served so you would be released later that day or you can waive your right to a speedy trial to get a court appointed attorney who most likely doesnt give two ****s about you and spend months or even years in jail awaiting trial that if you lose you could face 10+ years in prison. If your a poor black man let me tell you, you take that ****. Being innocent is not a good defense for poor black men in court. Even if you are its probably still a 50/50 chance.

I would also like to point out I have a serious beef with most judges for abusing their power to stop people from attempting to use or spread knowledge about jury nullification.

He has a distinct tattoo on his face. The conveince store worker picked him out of a line up but she changed her mind later (which people do when they're scared of testifying).

Not where I am from. Its routine policy to incarcerate people up to 7 days in a cell with no toilet, water fountain, or bedding. In the Evangeline Parish police investigation by the DOJ under Obama they admitted to it and that they knew they were wrong for doing it. Then they promised to play nice and the DOJ felicitated the officers. Better not do it again or we will investigate and release another report!

Here ya go

https://www.justice.gov/opa/pr/just...tion-ville-platte-louisiana-police-department

"The Justice Department announced today that it found reasonable cause to believe that the Ville Platte, Louisiana, Police Department (VPPD) and the Evangeline Parish Sheriff’s Office (EPSO) engage in a pattern or practice of conduct that violates the Fourth Amendment to the Constitution."

"VPPD and EPSO leadership acknowledged that the investigative holds are unconstitutional and have taken laudable steps to begin eliminating their use. "

Nope. Picked it out from a facebook photo a year later.

Rarely happens. Just take the fifth.

No, the 5th only applies to incriminating yourself. The court can compel people to testify. Or charge them with obstruction. A clerk wouldn't have a reason not to testify unless she herself did the robbery and could implicate herself in the line of questioning, that would be the only reason to plead the 5th on the stand.

it's like you are totally cool broadcasting that you don't know anything about the justice system in this country if you thought posting that was a good idea

Take a plea for jail time when you are innocent. I would NEVER do that.

ok

congrats

that as well is said like you don't understand the problems in our justice system from sentencing, the amount of things that actually go to trial cause of pressure from defense attorneys and public defenders, the loading up on charges and are you really going to leave it up to 12 idiots that can't figure out how to get out of being on a jury to be paid $20 for the day etc that lead to an absurd amount of plea deals happening in this country

So 100% innocent goldfly takes a plea deal for prison time?

Yes you would. You have to be in the situation to fully understand it.

For starters I wouldn't find myself in a situation where this would ever need to be tested. However if I was 100% wrongly accused of a crime I would never admit to guilt wrongly.

would say it all depends on what is happening and what the pleas is etc

i'm a gambler but i understand odds. if i am facing 10,15, 25+ etc and i'm leaving it to 12 idiots. i might take a plea and then continue fighting it from the inside on a much shorter stint

i have seen where a cop openly lied on the stand and the person that was innocent was found guilty cause it was he vs the cop and they sided with the cop testimony that wasn't true. would have saved a lot of time and money etc by just taking the plea deal cause it would have been less

Those last two paragraphs really portrayed blacks in a negative light didn't they? They are a real menace to society according to that sharticle. I assume that was the point the author was trying to make.
