there are competing equities here...minority students should feel that they can attend classes and live on campus without being subject to racial abuse

the white students can go off campus to express themselves...the university has an overriding interest in providing an educational environment that works for all its students

I believe the school could expel the students, but do not understand how the police can arrest them

the article is a little unclear what they are being charged with...do you have any information on that?

I think if I went into a private institution of any kind and started harassing the people there, they could call the police on me and have me arrested...no?

it is a public school...but I believe that government institutions (like private businesses such restaurants) have legal rights to set rules for people entering their facilities...in some cases this can override "free speech"...I don't think a student can stand up in a classroom and racially abuse others...it seems common sensical that in such settings one does not have the same protections for "free speech"

The school can discipline the students. The state should not be allowed to arrest them.

I guess this is more paranoia though

schools have a lot of leeway in terms of setting rules on who can come on campus and what activities they can engage in

actually schools rely on the state to help enforce their rules...just about every school has occasion to call in the police...its a judgment call in some cases...in this particular case, expulsion might be the best recourse

if I went to a supermarket and started racially abusing customers, the management could throw me out or they could call the police...both are reasonable choices depending upon how obnoxious and persistent I was

I think the supermarket has always had the right to throw me or anyone else off its premises for that kind of behavior


Store can tell you to leave. You’ll only get in trouble if you disobey the cops. Cops can’t charge you with being racist

well it is disturbing the peace or some such thing...now we have new laws...disturbing the peace while being a racist...progress!

actually it is not entirely a silly matter...I generally think we have too many laws...i'm not sure adding the category of hate crime makes much difference

We now have two examples of governments making laws / arresting people for what they say

if you're using your speech to harass someone and impedes them from getting their education etc

it isn't free speech

it isn't a debate or anything else that you want it to be to

it's harassment and can be criminal

your rights end when it involves what can happen/affect someone else. just like every other right


i'm sure you and your awful twitter follows will find another awful person to use as your martyr case of the impending war on freedom of speech though. lol
