After the responses to Kavanaugh and ACB, I'm trying to imagine the response if imaginary fascist Trump decided to try to expand the size of the court to get more of his kind on there.

I'm sure it would have been well receptor by the principled norms wanting lecturers
 
Would have been really cool if the public could have gotten a single foreign policy question in the two debates.

The judiciary is the one branch that actually works in a semi-effective way. Last thing Biden needs to do is mess with it.

And deciding cases against your viewpoint isn't evidence the court is broken.

I imagine the response would be the same as how Republicans would have reacted if Hillary won in 2016 but lost the popular vote by 3 million and expanded the court. "Full blown tyranny" is what I would expect Moscow Mitch to call it.




I don't think Biden has the balls to add justices. What I support is either setting the number at 9 in stone as well as the process and timeline for confirming justices or else go ahead and expand it. I dont Republicans to not expand the court the next time they have the Presidency and Senate. Adding a justice should require a 2/3rds majority of Congress which neither side will ever get, if Republicans oppose that they are telegraphing that they want to do it in the future. The honor system went out the door a while ago.

I doubt Trump knew they could add justices until it was brought up in the campaign. I could just as easily point to when Obama and Biden were in the White House with a Democrat controlled Senate and the subject wasn't brought up. If I had to guess this commission wont even release their report until late 2022 and if Democrats do it it will only be AFTER picking up seats in the Senate in 2022. If Republicans are going to campaign on "Democrats will add justices" and they still control the Senate after 2022 then it sounds to me like that's what the American people want.
