We're there mitigating circumstances that legally forced this prosecution to be federal?

Manpower? Is the DA's office staffed to prosecute?

Murder in California generally is punishable by 25 years to life in prison. However, with a special circumstance — such as gang membership or murder in the commission of another crime — a defendant can be sentenced to life without parole.

For what it’s worth, I think this is an important caveat. If the DA is willing to prosecute for the murder, but declining to turn a 25-to-life sentence into something more, that’s not nearly as nefarious as the blurb might suggest. I don’t personally think that being in a gang makes the murder worse. I’m really not a big fan of stacking charges in this way, as a life sentence is already a very strong statement, and if they’ve reformed themselves over the course of 25 years, I’d not have any major concerns with them having the possibility for parole.

Dear (R), please please please use this moment to expand school choice. Don’t waste your political capital banning CRT when (D)’s will simply reverse the ban next time they get power. Expanding school choice will give you a long-term structural win that will be politically impossible for (D) to take away in the future.
