Oklahoma Frat

I think a public university or private university should have the right to ban clearly racist speech/behavior. But the courts disagree. I'd just revoke the frat charter and let these guys be social pariahs.

That's the question that is really bothering you from this story? Really?

if it was my school, i would kick them out of my school

i wouldn't want those type of people around it

A public university is subject to the free speech guarantees of the First Amendment and may not punish students because they hold offensive views.”

they are punishing them (the 2 students) for creating a hostile environment on campus, right?

i could easily argue that stems from their speech though which is where i guess the fun comes in

just curious, where are you quoting from?

I read they have had black members in that chapter before. Nationally fraternities can be VERY different, but for that to have happened and then THIS, is just odd.

Free speech is and quite often has to be ugly and disgusting, if free speech were always what we WANTED to hear, all there would be is talk radio and the Kos.

This isn't a free speech issue.

They have the right to be idiots and say stupid things. The university and national frat also have a right to punish them however they deem fit for not wanting them to represent the university in that way.

School must not love freedom.

So, if they were chanting "abortion is murder" or "same sex relations are wrong" or "love live the Ayatollah" or some other sort of thing it would all be the same and everyone on both sides of this issue would likely feel just like they do today?

That might not be the case though, since it is a public institution. I don't know one way or the other, just throwing it out there.

Doesn't matter if it's a public institution.

The university has their own by laws and code of conduct.

This isn't a free speech issue. Nobody is going to jail. They were expelled. Taking it by that logic any child in public school should never be disciplined for saying something derogatory and disrespectful.
