Just a few reminders about Flynn's guilty plea.

1) For a lie to the FBI to be prosecutable it has to be of a material nature. This means it bears on the investigation as opposed to something trivial that does not impede the investigation.

2) The lie was about whether or not he asked Kislyak to refrain from escalating the situation with respect to how Russia would react to Obama's sanctions. Flynn falsely stated he did not ask Kislyak to do this.

3) Flynn also lied about a follow-up conversation with Kislyak in which Kislyak conveyed Russia agreed not to escalate the situation. In pleading guilty, Flynn admitted that this conversation in fact did take place.

4) The plea agreement stipulates additional facts (about other lies and false filings related to his registration as a foreign lobbyist). The stipulation means that Flynn agrees that he told those lies and made those false filings.

It has been asserted that the FBI agents did not think Flynn lied to them. In response to this assertion I would ask the following:

1) Assuming that they did not believe he lied to them, is it their determination to make?

2) Would they have the same information Mueller and his team had? They may not have had the information needed to evaluate the veracity of Flynn's testimony.

3) What are the source(s) behind the claim that the FBI agents did not believe Flynn lied?

4) Flynn faced quite a few other serious charges. He chose to please guilty to those particular charges. If he hadn't he would be looking at far more legal jeopardy.
 
We would also do well to remember Flynn's own words after he pleaded guilty:

I recognize that the actions I acknowledged in court today were wrong, and, through my faith in God, I am working to set
things right. My guilty plea and agreement to cooperate with the Special Counsel's Office reflect a
decision I made in the best interests of my family and of our country. I accept full responsibility for my
actions.
 
We would also do well to remember Flynn's own words after he pleaded guilty:

I recognize that the actions I acknowledged in court today were wrong, and, through my faith in God, I am working to set

things right. My guilty plea and agreement to cooperate with the Special Counsel's Office reflect a

decision I made in the best interests of my family and of our country. I accept full responsibility for my

actions.

He's a good solider but recent events in the Flynn procedings should inform the country that there is more than meets the eye

September 17 set as the date for Manafartov trial. This is for the charges where DC is the venue. There are another group of tax-related charges that will be tried in Virginia.

September 17 is an interesting date from a couple of perspectives. It gives Manafartov plenty of time to contemplate his options.

Also ensures the trial will be going on in the runup to the mid-term elections.

One other Manafartov related thought. His bail should be revoked. He is a flight risk. He has violated the judge's orders multiple times. She noted today that the statement he released after Gates entered a guilty plea violated her gag order and reprimanded him for it. His safety might also be at risk. The collateral he has offered for bail looks like it might be subject to claims by various parties. It seems to me there is a good case for locking him up now.
