Employment laws are statutes passed by Congress and Congress can't tie the hands of how Congressmen vote.

Basically the Constitution gives a Congressman the right to vote however they wish for any reason they wish. How they vote is something they answer to their voters for.

It's still insane you have people in Congress openly declaring they won't vote to confirm based on the race of the nominees.
