Actually, I don't think his activities on January 6 constitute insurrection (though there was plenty of dereliction of duty). But his broader activities in trying to overturn an election was an attempt to subvert the constitution and prevent the peaceful transfer of power to a duly elected president. On those grounds I think he should be disqualified under the 14th amendment.

The lawsuit was brought by 6 Republican voters and the state was a defendant in the case. The lawsuit sought to compel the state to take an action. And the insurrection was the entirety of the actions taken to subvert the election results. Anyone is free to use all their legal options to challenge election results. When a person legal options run out and they continue to seek to subvert the results and use means of intimidation to try to forcibly change the results they are engaging in an insurection.

Again, why would I care about who brought the case?

Has trump been convicted of a crime?

Are you telling me that sturg33 can find a super red jury to opine on Joe Biden committing treason with his border policies... and you'd be perfectly fine with it?

You're saying 6 people brought a case to a state that had nothing to do with Jan 6... and a completely Democrat judicial ruled against their political opposition

i wouldn't have a problem with voters trying something similar against credibly accused creepy joe

their attorneys might end up being sanctioned if they draw a judge who doesn't like frivolous lawsuits

So.we should be happy we have a system that a Supreme Court that has an advantage by 1 judge can decide if a political opponent is legitimate or not?
