New start date for Trumps felony business fraud and election fraud in NY set at April 15th. Supposed to be a six week trial so Trump could be a convicted felon as early as June.

Maybe I’m old fashioned, but if a candidate for the presidency

is so deficient in self-restraint that it requires a judge’s gag order

to keep him from publicly threatening the lives of innocent people

because he has the moderation of a rabid rat in a pizza place,

it should be pretty f’ng disqualifying, right?
 
And he's already violated the gag order. Anyone else straight to jail. Trump gets a stern talking to if anything at all. Tired of this two tiered justice system.
 
I thought Trump being a former President and first offender wouldnt get any jail time for the NY felony charges but with his attacks on the Judge, who will be passing sentence, I am not so sure of that. I just saw another case where a Judge gave a first offender two 90 sentences to run consecutively that would normally be suspended just for calling a cop a pig. Now we know Trump always gets favorable treatment because he is at the top of the tiers of justice but I wont be surprised if he gets himself a 90 sentence out of this. Wont surprise me to see him get an appeals bond but considering the evidence against him theres no reason to believe he would win an appeal.
 
Some key developments in the Trump documents case taking place. Trump appointed Judge asked for the prosecution and defense for comment on two proposed potential jury instructions that are highly favorable to Trump. Jack Smith cant appeal that because they are just suggestions but in a filing last night Smith asked Cannon to declare if she intends to allow the theories she used in those jury instructions for the trial so they can appeal it before the trial starts.


The first set of jury instructions tells the jury to decide wether each document fell into the category of "personal" or "presidential" as laid out by the PRA.


The second set tells the jury to assume Trump had full authority to take whatever he wanted.



The whole case other than the obstruction charges really comes down to the jury instructions. Under these set Trump would be found innocent, If Smith wins the appeal then the PRA wont even be a defense Trump can bring up which means a conviction is extremely likely. So the whole case rests on this upcoming appeal.

Donald Trump didn’t post cash for his bond.

In fact, AG Letitia James filed that the company who did,

Knight Specialty Insurance Company, didn’t even bother

giving them the certificate that they were even qualified

to post it for him.

She’s now asking them to do so. Otherwise it’s null and void.

Again, you are comparing apples to monster trucks. No ones in trouble for election lawsuits or objecting to the certification. Not one Congressman who voted not to certify has been arrested or disbarred. Not one AG who filed an election lawsuit has been arrested or disbarred. So why you keep asking why people who arent in legal trouble for doing something that other people didnt get in legal trouble for is beyond comprehension.


You know what is a crime? Filing documents stating that certain people are the certified electors from a state without stating that it is contingent on a reversal of results from a pending lawsuit. Stealing a voting machine. Soliciting voter fraud. Soliciting a state official to violate their oath of office.

Trumps motion to dismiss based on the PRA denied. Judge also backs down on her ridiculous jury instructions. She seems to be signaling that she will allow Trumps lawyers to try to use the PRA as a defense. Thats going to be appealed to a higher court whether it be now, during the trial, or at jury instructions.



The term "Presidential records" means documentary materials, or any reasonably segregable portion thereof, created or received by the President, the President’s immediate staff, or a unit or individual of the Executive Office of the President whose function is to advise or assist the President, in the course of conducting activities which relate to or have an effect upon the carrying out of the constitutional, statutory, or other official or ceremonial duties of the President. Such term--

(A) includes any documentary materials relating to the political activities of the President or members of the President’s staff, but only if such activities relate to or have a direct effect upon the carrying out of constitutional, statutory, or other official or ceremonial duties of the President; but

The term "personal records" means all documentary materials, or any reasonably segregable portion thereof, of a purely private or nonpublic character which do not relate to or have an effect upon the carrying out of the constitutional, statutory, or other official or ceremonial duties of the President. Such term includes--

(A) diaries, journals, or other personal notes serving as the functional equivalent of a diary or journal which are not prepared or utilized for, or circulated or communicated in the course of, transacting Government business;

(B) materials relating to private political associations, and having no relation to or direct effect upon the carrying out of constitutional, statutory, or other official or ceremonial duties of the President; and

(C) materials relating exclusively to the President’s own election to the office of the Presidency; and materials directly relating to the election of a particular individual or individuals to Federal, State, or local office, which have no relation to or direct effect upon the carrying out of constitutional, statutory, or other official or ceremonial duties of the President.





What can be considered Presidential Records and Personal Records is clearly defined and if they are official records of an agency that doesnt even fall under either So theres no argument that if Trump had a CIA classified document that he could declare that his own personal record.
 
Official agency records also have a HUGE list of exceptions so your absolutism isn't fact.

The agency thing won't hold up in court.
 
Trumps bond in NY has been rejected because it did not comply with NY law which says the bond company has to show their financials to prove they have the ability to pay. The bond company is arguing they dont have to comply with NY law because they are in California. Which is can only be described as a..... special..... legal theory. Considering Trump had to go to this company that specializes in high risk loans I wonder how many other companies would be willing to do business with him.

In every motion by Trump's legal team they aren't claiming he's innocent. Here is what they are claiming.

- Trump has total immunity to hold Top Secret Documents.

- Trump has total immunity to hold nuclear secrets.

- Trump has total immunity to sell and show foreign adversaries nuclear secrets.

- Trump has total immunity from lying to the Department of Justice.

- Trump has total immunity ignoring a Subpoenae.

- Trump has total immunity to pressure elected officials to overturn the 2020 election.

- Trump has total immunity to pressure fake electors to sign illegal documents.

- Trump has total immunity telling the Vice President to ignore the constitution.

- Trump can ignore gag orders.

- Trump can threaten witnesses and those about to give testimony.

I will tell you even if you are frustrated that time is about up. Trump will pay the price for being a criminal, rapist, and a fraud.
