The 'legal merit' is completely ancillary to the process because that is not actually why they are bringing it up. Its plain as day but Vance makes a good point either way and from what I'm seeing this type of challenge was expected and the hope is the SC emphasizes the supremacy of the executive branch in how they administer executive duties.

If a challenge were expected, it’s because there are statutes suggesting it’s illegal. You had a much different thought process on it when it was student loan forgiveness.
