Next, what exactly is a sham. Trump tried to conceal that he was paying back Cohen for hush money payments during a campaign by falsifying business records. That's a crime whether you like it or not or think it's significant. The next question is whether it was done to conceal a crime which would make it a felony. Federal crimes have been used to raise the state charge to a felony many times before. There has never been a case where a federal campaign finance violation was used. There is a legitimate argument to make regarding whether that amounted to federal campaign violation but its not a great one. I don't know if the jury has the option to convict on misdemeanor charges or if it'd a felony or nothing but he is caught red handed on the records part.
