VP has access to classified documents. Accidentally not returning them isn't a crime. You can believe it wasn't an accident all you want but unless there's proof of intent it wouldn't even pass a grand jury. So unless Pence does what Trump did and admits to purposely removing them to keep there's no case to make. These sweeps are done at the consent of the person, that they allowed them to come in search and take anything classified shows they had no intent to retain the documents. Which is the opposite of what Trump did.
