You must have missed the word "order". Trump freely admitted he asked Bill Barr to go after Hillary. By your logic no Democrat Trump has ever said should be prosecuted publicly could be prosecuted. Just about anyone can make a criminal referral to the DoJ. Rand Paul made one about Dr. Fauchi recently. Theres nothing wrong with suggesting criminals be prosecuted.
