The only thing he should be in jail for is his lousy stage name. Tiny Doo?

...
or, maybe, a phonetically skewered interpretation of 'Tiny Dude'?
The only thing he should be in jail for is his lousy stage name. Tiny Doo?
If people want to be technical is the KKK even a gang? Or are they a hate group?
Are hate groups covered under gang laws?
If those KKK albums are made and sold in California they should be held to the same charge as this guy as long as the same criteria is met
And Sav is making a fortune from our forum dues.
AA, San Diego has horrible gang violence. like one out of every three major crimes in the city is gang related. So it sounds like to me that the City is trying to destroy anything gang related. Which I would think we'd all want except for the race batters. This rapper is rapping about a certain gang, name dropping people in the gang and glorifying what the gang does. By the definition of the California Gang Act and even the Son of Sam act, the DA can go after this guy for being an accessory to the gang.
That's all in print if one chooses to read it. This has nothing to do with freedom of speech.
I wouldn't be surprised if this guy is connected to the gang but the DA couldn't get anything concrete so they went this route.
It's 100% about freedom of speech. Though I'm not surprised you advocate for this
This particular law is stupid, but it's not a freedom a speech issue. He is being charged under this law due to allegedly making money off gang violence. The issue is that he is making a profit from gang violence.
It's a stupid law regardless.
You're entirely missing the point. He can Rap about whatever he wants. What makes what he did "illegal" is making money off it. Making money is what was unlawful, not actually what he rapped about. And as I said, it is a dumb law. It should be unconstitutional. In this particular case way, there is no way this should hold up in a court of law. But freedom of speech was not the issue, imo.
So if no one bought his album or whatever, he wouldn't be arrested?
Carp, thanks for actually reading up and understanding the charge.
There's no limiting of a guy's speech going on, it's not allowing someone to publicly promote Gang violence. It's the last part of 'particapting in a Gang':
1. The Legal Definition of the Crime of "Participation in a Gang"
(Penal Code 186.22(a) PC)
Penal Code 186.22(a) PC sets out the legal definition of the California crime of "participation in a gang."6
In order to convict you of the offense of "participation in a street gang" under the STEP Act, a California prosecutor must prove the following three facts (otherwise known as "elements of the crime"):
You "actively participated" in a criminal street gang;
You knew that the gang's members engaged in a pattern of criminal gang activity; AND
You willfully assisted, furthered, or promoted felonious (felony) criminal conduct by gang members.7
