Is there a clear and present danger that you have identified? Are there minorities being beaten on the streets by their oppressors where an action such as this could result?

I'm confused by your logic of using history from over a 100 years ago to restrict our speech today.

I'll use my analogy from before. Suppose the campus Catholic group was going to have a Cardinal come and speak. You go and protest by shouting at the gathering "Catholics like little boys". You're creating a hostile environment for the Catholic group. Why should your speech be protected?

Yelling "fire" in a movie theater is part of an extremely narrow carve out of speech that will incite immediate physical violence. It's entirely different than speech that is merely offensive to the listener.

How other students making noise in the parking lot have been treated is a relevant factor. If you only punish those expressing objectionable ideas, you're regulating based on content.

In any event, the idiots are being charged under a ridiculously unconstitutional starute, not for disturbing the peace.

The ACLU has defended the KKK and Nazi groups left and right over the years. The reason for this is they know an exception made in those cases could easily be weaponized and used against other viewpoints.

Content based regulations are bad. That's the touchstone of first amendment law and for good reason.

Were there complaints of other students making noise, and were they specifically using obscene language/gestures? I know obscene language/gestures is vague, but many laws are vague and it doesn't stop police from arresting folks for those crimes. Seems like a judgement call from the police at that point.
