If this Florida law was in effect in DC on January 6, everyone at the rally including presumably the speakers would be open to a felony charge. Just sayin.

Any mention of mandatory prosecution or minimum sentencing? I know that there's been a problem recently of Democrat prosecutors dropping all charges, so it's something that I would expect the adults to address.

I don't think prosecutorial discretion is a problem. If I were a prosecutor with a backlog of protest-related charges, the only ones I would prosecute would be for acts of violence or property crimes.

I've expressed a similar view with respect to January 6. The MAGA tourists in my view should be let off with a slap on the wrist. Maybe community service or a small fine. Even for the folks who wandered into the capitol. For the ones who broke in, or carried weapons, or maced or otherwise assaulted police, or damaged property that's a different matter. And certainly if there is proof of advance planning of these things, the planners should get the stiffest penalties.

Those DA's are elected sir, so they are simply doing the will of the people. Or atleast thats what I was told about Republican state legislators trying to override their states voters. So vote them out if you dont like it.

A lot of the protest related charges are hard to prove and juries might just outright refuse to convict. Prosecutors dont like taking L's on their record. As for the MAGA tourists, as I have said before, those who are first time offenders who express remorse for their actions will get a slap on the wrist. Likely time served and probation. Those who double down on their crazy will get serious time. Most of them need a mental health evaluation but they would probably never get out the nut house.

As you point out, the state legislatures are also elected. So if they decide it's in the interest of the state to not allow DAs to decide whether to prosecute crime based on whether that crime was politically expedient, that's their right. I hope they use it.
