§2383. Rebellion or insurrection
Whoever incites, sets on foot, assists, or engages in any rebellion or insurrection against the authority of the United States or the laws thereof, or gives aid or comfort thereto, shall be fined under this title or imprisoned not more than ten years, or both; and shall be incapable of holding any office under the United States.
You know as well as I do that there are umpteen million overlapping laws. Caleb Berry is charged with conspiracy against the United States. I will leave a quote straight from the indictment. Prosecutors have most of these people red handed and are going with the numerous easily provable charges. There is no reason to seek a controversial charge like rebellion when the max punishment is 10 only 10 years.
