You know as well as I do that there are umpteen million overlapping laws. Caleb Berry is charged with conspiracy against the United States. I will leave a quote straight from the indictment. Prosecutors have most of these people red handed and are going with the numerous easily provable charges. There is no reason to seek a controversial charge like rebellion when the max punishment is 10 only 10 years.

not good enough...does not contain the word sedition or insurrection or rebellion

although confederate has a certain historical resonance
 
It's weird that the narrative is universally an insurrection from your media masters but they can't seem to charge anyone as such
