Legal/scotus thread

The presumption of innocence given by white male America is astounding.

Unlike Trayvon Martin, who was assumed guilty of, something.

Talk about ruining someones life.
Of yeah, Dr Ford has to move due to threzts

"Somewhere in America, a teenage boy is listening to his parents convict Brett Kavanaugh and he is thinking, if I'm ever accused, with no witnesses or evidence, everyone will just assume I'm guilty."

dont get accused

What if the accuser gives credible testimony and the accused prevaricates and obfuscates?

I mean, unfortunately, that’s how sexual assault cases often have to be litigated, because it’s not unusual for the accuser and the accused to be the only witnesses. So unless you’re comfortable basically never prosecuting any sexual assault cases, you’re left with considering testimony as evidence, and weighing the credibility of the parties. Even if you had doubts that BK did it, it seems like he pretty transparently lied to avoid the conclusion that he might have done it and not remembered it, or even considered it NBD. I’m still surprised and disappointed that this has not been sufficiently acknowledged.

It’s all academic at this point—and that’s leaving aside that we are talking about a confirmation hearing, not a criminal trial. But for whatever it’s worth, politics aside, it was hard for me to escape the conclusion that on that day, one party was lying and the other party was truthful.

I agree that some sexual assault cases are prosecuted without evidence. Those are done within a timeframe that allows relevant data to be obtained. I think you work in law don't you Julio? How many prosecutors do you know that are going to be willing to take a case that's 35 years old, has no witnesses, has no firm location, and has no firm year (much less date?)

and again, this is not a prosecutorial situation.
and for all of the griping of making it political, nomination of Supreme Court Justices is a political endeavor

Why do you insist on creating this confusion ?

Ok, what about the multiple accusations of perjury.

That's a much more easy to prove complaint. I'm surprised the opposition didn't focus on that instead of an unprovable sexual assault accusation from the Reagan years. Someone as talented as Feinstein is should have been able to make quite a bit of hay with it, if that was the concern that united nearly the entire caucus against Kavanaugh.

Well confirmation doesnt stop him from being prosecuted. That would make him a convicted felon. Not sure he gets prison time because prison is for the little people.

Which brings me to another thing. I am tired of government employees patting each other on the back and thanking themselves for their "service". Few if any congressmen are there for anyone but themself. Judges have thr cushiest job you can imagine. Cops get ridiculous retirement benefits and are the most protected class of people in America. These jobs are not about service.

my guess is a lot of the people who are so adamantly against the MeToo movement and women coming forward with allegations in general have some...shady things in their past that they don't want coming to light. may as well work to discredit most (all?) women now, especially when they're given cover from people like, you know, the president. this way if what they did ever comes out, they can dismiss it and say it's just another woman trying to get attention (in the form of death threats).

and what do you teach your sons ?

Make her take yours and her clothes off so there is no doubt and if you think you will be accused then accuse them first. The standard which boys are expected to act is ridiculous and if we need to apply the same standard to women. I dont know about the rest of you but rarely does a woman ask for consent.

and what do you teach your sons ?

what were you taught ?

I wasn't taught anything. I knew from common sense, but not everyone (including women) always act with common sense, decency, or respect. I teach my boys to respect women. When its time to talk about that, we will. That's no longer good enough though. It is getting to the point where you can't be alone with a woman as a man, and not open yourself up to things like this. Neither sex is above lying for their own gain.

This happened to a friend of mine in college. Near about ruined his life and post grad career. Girl was mad he wouldn't date her and wanted revenge so she lied and told her parents he forced himself on her.

Also happened to a girl I went to HS with. She accused her father publicly of assaulting her repeatedly. Was later found to not have ever happened and the family was destroyed and the dad rarely shows his face in public.

NOTHING prevents accusations from being made and potentially ruining lives. But you knew that too. It just fits your narrative on this issue better.

we are still talking about being falsely accused - right ?

Let me get anecdotal
In the early 1990's SI investigated a rash of youth coaches being accused of improper relations with players.
The organization I was affiliated with at the time insured itself and coaches to educate, cover legal fees and protect the public perception of the organization.
In the day long seminar (which are still mandatory per HR departments of many/most companies) it teaches how to avoid the appearance of wrong doing.
Not only was this training helpful in my life but was an example of how to teach others. In this case my children
I would bet 3/4 of the posters here have been through such training.

Let me ask you too, have you ever been accused of impropriety ?
If not why?
If so, why ?

This is a poorly thought out post.

Guilty until proven innocent is a poor way to conduct justice. But you knew that.

Where was your selective existential outrage when Trayvon Martin was shot ?

"Guilty until proven innocent" is a fact of life to a great number of Americans (Central Park 5 )
Cajun posts stories almost everyday of instances of "guilty until proven innocent"

Common sense is a skill to my mind and has to be taught. Either directly or indirectly

I asked if you had sons and what you teach them ?

Neither of those real life instances could have been prevented by training. They were baseless accusations made public for some kind of retribution.

Never had an issue with it, but neither did those two instances either. So goes to show that maybe... that’s not enough ?
