Scalias seat was vacant because there wasn't enough support in the Senate to confirm Garland.

Kennedys seat was vacant because he retired.

RBGs seat was vacant because she died.

This was so heavy handed that as far as I’m concerned there is nothing too far out of bounds if it remedies it. Honestly the conservatives have thrown out the rules so we should just have a street brawl for power. In some ways I do lean a bit conservative but this Republican Party is disgusting. I’m afraid we’re going to face the tyranny of the Christian Right in the Bible Belt states and it must be defeated by any means necessary.

There are tons of plans to invalidate absentee ballots and extreme lines even in early voting in large cities in Republican controlled states. I also know a fair number of people who haven’t received absentee ballots who ordered them. There are a lot of shananigans going on.

Of course we’re definitely going to win the popular vote by a wider margin this year. It could be over 8 million but we’ll be waiting on 100k margins in a couple strategic states most of which have a Republican Secretary of State.

And y'all couldn't get the Notorious RBG to retire before Trump.

Depends on the issue. For abortion the court has been fairly consistent to the left for decades. Gay rights has been largely to the left the last few decades as well.

However, you've seen growth in free exercise law which is a rightward shift. Citizens United was interesting in that it was an expansion of free speech (generally a liberal ideal) applied in a conservative way.

Ultimately the court can only be pulled as far as the most moderate 5th justice. It doesn't matter if you have 4 extremists, they need the 5th to make a majority so they can only go as far as the 5th is comfortable.

That's been the thing, for the most part the court's makeup for the last 30 years or so has been a few extremists (Ginsberg, ALito, Brennan, Thomas, Rehnquist) They've countered that with some wild cards, like Kennedy who could be a swing. before RGB's passing the closest to a swing the court had was Roberts who while pretty danged fair, certainly has a lean that's conservative.

Will be interesting to see where this goes. But the dems retaliating and adding 2 more justices is an option, not one I'd like, I'd rather them draft up a constitutional amendment to change the court makeup and institute term limits. Something that will allow the court to more represent the times rather than it's current status where it seems to yo-yo wildly at times.

I totally understand why Democrats are upset about Garland. Mitch and Co. boxed themselves into a corner with the justification they used. On the surface, it’s total hypocrisy in the name of partisanship. Mitch should have just been more blatantly truthful in why they wouldn’t confirm Garland.

With that said, the level of doom and gloom over a perfectly legal and reasonable confirmation process is off putting. If Democrats want to find a way to fire up a mid-term red wave, whining and threatening to pack the courts is how that is done.
