Marbury v. Madison, 5 U.S. (1 Cranch) 137 (1803), was a landmark decision of the U.S. Supreme Court that established the principle of judicial review, meaning that American courts have the power to strike down laws and statutes they find to violate the Constitution of the United States. Decided in 1803, Marbury is regarded as the single most important decision in American constitutional law.[1][2] It established that the U.S. Constitution is actual law, not just a statement of political principles and ideals. It also helped define the boundary between the constitutionally separate executive and judicial branches of the federal government.

The case originated in early 1801 and stemmed from the rivalry between outgoing President John Adams and incoming President Thomas Jefferson.[3] Adams, a member of the Federalist Party, had lost the U.S. presidential election of 1800 to Jefferson, who led the Democratic-Republican Party. In March 1801, just two days before his term as president ended, Adams appointed several dozen Federalist Party supporters to new circuit judge and justice of the peace positions in an attempt to frustrate Jefferson and the Democratic-Republicans.[4] The outgoing U.S. Senate quickly confirmed Adams's appointments, but outgoing Secretary of State John Marshall was unable to deliver all of the new judges' commissions before Adams's departure and Jefferson's inauguration.[4] Jefferson believed the undelivered commissions were void and instructed his Secretary of State, James Madison, not to deliver them.[5] One of the undelivered commissions belonged to William Marbury, a Maryland businessman who had been a strong supporter of Adams and the Federalists. In late 1801, after Madison had repeatedly refused to deliver his commission, Marbury filed a lawsuit in the Supreme Court asking the Court to issue a writ of mandamus forcing Madison to deliver his commission.[6]

In an opinion written by Marshall, who by then had been appointed Chief Justice of the United States, the Supreme Court held that Madison's refusal to deliver Marbury's commission was illegal.

The issues of the day regarding presidential powers and judicial review came up early in the life of our Republic. Marbury v Madison is the landmark decision. But there are also plenty of subsequent cases that build upon it.

The military will be trimmed by DOGE. Not worried about that.

But what if a Radical Leftist Cultural Marxist version of DOGE decided the military is evil and disbanded it? Or that we could let in so many migrants if we just eliminated Border Patrol!

A government official is declaring government actions the public is interested in are being posted on his website. Why even have laws about conflicts of interest?
 
But there’s a question on whether or not the entire executive branch holds the power to not disperse funds as appropriated by the legislative branch. The check on that power is the power to veto the spending bills. The executive branch did not do that with these pieces of legislation.

There's not much question. The SCOTUS will have to give us the answer to what is already known. Waste of time and resources.

I don't have knowledge of every single EO but the only one that looks to be beaten is birthright citizenship. Trump doesn't have enough originalists on the courts to help him.

If SCOTUS does disagree with you, will you accept Trump is acting illegally or just move on to suggesting SCOTUS is the deep state?

The courts are going to be asked to decide some tough and novel questions the next few years. I don't think precedent is going to be as helpful as it normally is. At the end of the day I suspect Trump will succeed in enlarging presidential authority (at Congress' expense). I don't have a dog in this fight. But thangs will change.

In my area it’s the conservatives that do.

The dems seem to only worry about their kids sometimes and others they don’t worry about anyone but themselves. Our Dem mayor making 200+k claimed the free school lunch program for low income earners for his time in office.

It was quite the scandal.

We are a 68/32 ish african American here. Got a lot of weight pullers in that 32 through tax and private donations - and their own time.

Left either blatantly lied or was careless in assertions time and time again during then Biden regime. I don’t care if musk and team get some things around the edges wrong. The underlying premise is still correct.

This is more like a Trump lie than a leftist lie like vaccine will stop transmission.

How? Congress is who decides what is spent. Trump can use his power of veto on the next spending bill if he wishes, but this money has been legally appropriated.

Congress appropriates money to the executive branch. Trump can't change the amount of money given to him. Unless something is spelled out in black and white from congress the block of money is up to the president to where the money is spent.
