Any time someone resists arrest they get charged with resisting arrest. Being wrong or right (as I saw it he was just arguing with the cops before getting jumped by the cops) doesn't matter. Police should have arrested him, and slapped him with a resisting arrest charge, not EVER put their arms/hands, etc around his neck or sat on his chest, etc.

You can ask a cop to leave you alone if you're not committing a crime. My uncle was pulled over several times by the same cop while not committing a real infraction and threatened him with a harrassment complaint. Guess he should have been choked out.
