What happens when you mix AI and incompetent police. Cop believes AI even over the governments Real ID. They tell him we will just Id you at the jail and if its not you we will let you go. When it comes back as not a match they just change John Doe on the arrest document to his name and STILL charge him with tresspassing. The cop on his report said the man couldnt provide proof of his identity despite having multiple forms of ID.
 


Here is a great example of the problem with policing and I am going to show what would solve this problem.


1. Any person charged with a crime should have the right to have any credible criminal actions against them fairly adjudicated. If the DA doesnt want to prosecute thats fine. A victim should be able to hire a private prosecutor. To ensure they are only taking legitimate cases they would only be paid by the state if they win. When they prosecute the civilian they give up their right to prosecute the case because they would tank the case on purpose rather than let a real prosecution happen. If they were going to charge them that would relevant to the civilians trial, so when that case ends the prosecutor no longer has sole jurisdiction to prosecute. I have no doubt there would be frivolous charges, but thats not seen as a problem when civilians are the victims of false charges. When civilians complain cops say "you will have your day in court". If I am anti-cop for wanting cops to have their day in court then wouldnt that make them anti-civilian.



2. You should be able to hire your own attorney at the states expense if you win. The public defender system is a scam. They wont tell you that you have to give up your right to a speedy trial. So when you get arrested based on nothing and accept a public defender you might be sitting there for years because the typical strategy is to delay if they dont have evidence. A public defender will be real nice about it. These are his friends. People he deals with on an every day basis. A private attorney in the same situation will raise hell. A public defender gets paid no matter what. Doesnt need good reviews or satisfied customers because you got no choice;. There are many good people who are public defenders but there are also sleeze bags who are secretly working with the prosecutor and Judge.


3. Whatever your bail amount is it should be paid to you upon release without a conviction. The reason for this is to incentivize honesty in bail hearings. Judges would be incentivized to actually care about whether there is PC or not. They might care about giving a 2 million dollar bond to someone with no evidence they did anything. I would call this the Kyle Rittenhouse law.



4, Whatever is paid to the jail for you being there should go to the victim if he is not convicted of a crime. They are generally paid based on the jail population. The point is the incentivize only legitimate arrests and to discourage using jail as a means of torture to get a plea deal. It also needs to be a crime to hinge dropping charges on not filing a lawsuit. That technically probably is a crime but again, unless citizens have the ability to persue it it will never happen. Thats classic witness intimidation. Personally if I am in that situation I sign the paper then immediately go see the Judge and tell them I was forced to sign it against my will and ask the Judge if this is conduct they condone by officers of the court. If a jail knows a cop is corrupt eventually they will stop taking his prisoners because they wont get paid for it. Its all about the money. Give them a financial incentive to care and it will do wonders.



5. Promotions, overtime and hiring for cops should take into account their arrest record/history and money they cost the government, If last year I falsely arrested 10 people who combined cost my department 2 million dollars and I got the department sued where they lost another 500k should I really be in line for a promotion? Should I be getting 40 hours of overtime every week? As it stands now that cop who costs them millions would get hired over the cop who turned in another cop for being a crook. Thats because they dont live by the free marklet principles.



6. Lawsuits against the government for police corruption should be paid for directly by the tax payers,. Much of the problem is that people like their corrupt police. I am from a small town in LA. Everyone there knows the cops target out of state drivers because a major highway goes through the town. No one cares because they see it as bringing in revenue for the town. One day when it all comes crashing down and the city is lookjing at a 10 million dollar payout they will want to say its not their problem. Not their responsibility. You elect the Mayor who is over the police. You turned a blind eye to organized crime. You are respnsible for their actions.
 


Another one. Why is it ony the civilians actions can be viewed through a criminal lense. How can he be not guilty but the cops did nothing wrong. The cop lied about the call claiming he was rough with her. They had any number of options to investigate and dispel any suspicion. Instead they hyper focus on getting his ID instead of investigating then claim. There is nothing on his ID critical to the investigation. The cop at the end lets the cat out of the bag saying they cant threaten to arrest him for not IDing because that would mean they compelled him to do it because that would be coercion. That is a literally confession to a crime. So the DA refuses to prosecute. The Police Department said they did nothing wrong. When he sues they probably get tossed out for QI. So how is he supposed to get justice. How is this supposed to be solved so it doesnt happen again if the only place the facts can be adjudicated is in the criminal trial of the victim.
 



Now I know damn well this guy is a Trump supporter. Neighbor calls the cops and says his neighbor is shooting his gun. Which he is allowed to do on his own property. Cops get there the guy says he may have shot in the air but he didnt see him do that. Cops talk to the guy with the gun. He says he did 2 shots in the ground to scare off chickens under his mower so he could mow the grass. Everythings good the cops acknowledge theres nothing wrong with that. Then they ask for his ID. This is in Tennessee, you are only obligated to give ID if there is reasonable suspicion/probable cause for a crime. There wasnt even an allegation of criminal conduct because the caller admitted to not seeing him fire shots into the air. He just threw that out there as a possibility. The gun guy talked to the police calmly. Didnt resist or shit talk them. Explained what he was doing. Then they ask for his ID which he rightfully refuses. Cops threaten to arrest him. He says thats fine we can settle this in court and turns around and places his hands behind his back to get cuffed. He points out to them what they always say, "we dont conduct court on the side of the road, if you think you did nothing wrong you will have your day in court. When they arrest him he points out that they are opening up the county to a lawsuit. So the cops gather round and conspire on what false charges they can load him up with to teach him a lesson. Obstruction is a very minor charge so they add on reckless endangerment since they know that will require a lot more bail money of which he doesnt get reimbursed when he wins. The guy asks the deputy to give his car keys to his wife because thats the only vehicle she can transport their 3 kids in to come bail him out. She agrees then refuses saying since he said he was going to sue she is going to make this as painful as possible for him and his wife.


So the cop writes up a probably cause report for the Judge which is filed under penalty of perjury. The cop lies that the caller said he saw the gun guy shoot in the air and then lies again saying the gun guy did not cooperate with the investigation so they had no choice but to believe the caller. The Judge who only has this cops false report to go on rules that there is PC and gives the man a 25000 bond. His wife has to work in the morning and they dont have anyone else to watch the kids so they have to pay 2500 to bail him out. They have to pay 3500 to a lawyer and the prosecutor folds almost immediately when a real lawyer shows up. If he took a public defender they would have delayed and dragged this on for months then drop the charges the day before trial to maximize harm to him. So this guys out 6000 dollars for bail and a lawyer. This is what they could do to a man who did nothing wrong but the cop who blatantly commited atleast 2 acts of perjury resulting in false imprisonment will never have to defend her actions in a criminal court. Now these officer are free to do this again to someone else all while claiming ignorance of the law. They should have to answer for what they did to this man. They should at the bare minimum have to acknowledge that he was right about the law and they were wrong because as long as they can claim ignorance the courts will keep giving them QI. How can they arrest a person who then beats the case because they were wrong on the law and then they can claim to still not know they are breaking the law. This is not a justice system. It is designed to create injustices.
