I honestly don’t think that’s likely to be all that true given the very public disclosure of his crimes. For one week early 2019, sure. There are certainly some people that stupidly stuck behind him, but most people saw his crime for what it was.

I’m guessing legally it’d be very difficult to charge someone with a hate crime when there’s no tangible victim. That’s also probably why a harsh sentence would be difficult. Legally I don’t see how it’s any different than calling the police and claiming you saw a crime that didn’t occur. Without a victim or insurance claim or whatever, it’s just a basic false police report charge, right?

I think it's quite a bit more nefarious than a false police report report because it's designed to stir up group animosity. Your point about a specific victim is good, but we prosecute people for victimless crimes all the time. I'm not saying that there is a law that he should be charged with, just that there should be.

I’d think that a good percentage of people would largely agree with you. My only worry would be the practical implications and enforcement. Where would we draw the line on inciting group animosity? I’m always wary of giving the state more power to make qualitative judgements about how bad a crime is without sufficient definitions.

That said, I fully agree that what Smollett did was much worse than a simple false police report. I just don’t know what the solution would be to accounting for that.
