Impeachment II

Trump should be pressured, forced if need be, to testify at his Impeachment. There's just no excuse for a President who will not testify at his own impeachment. I can understand regular folks taking the 5th, but a President is a pro at communicating. If he can't stand up and give an account of his actions that tells you a lot about his situation.
 
I read someone saying that the Democrats picked the worst reason possible to base the articles of impeachment on in Incitement of Insurrection. Basically, Trump's lawyers will show a bunch of clips of inflammatory statements made by Democrats (including the idiotic statements made by Maxine Waters). The idea being to show Democrats make the same kinds of statements but haven't been punished by Congress. It also opens up the door to arguing that Trump was just out there using his right to free speech.

The smarter course would have been to bring him up on charges for his reaction to the violence. His refusal to act to the point that Pence had to step in and get things moving. Basically give him the option of looking like he was either shielding the rioters or else utterly incompetent and asleep at the wheel.

But we're seeing politicians making moves based on emotional reactions more and more often these days and inciting an insurrection is much more inflammatory even if it is less strategic.

I agree with this, though I’m still on the side of the whole process being wrong this time around. They rushed into impeaching him instead of investigating whether or not there was something of substance there. I would have preferred an investigation into his actions involving fundraising off of the Stop the Steal campaign and where that money went. While it wouldn’t have led to an impeachment trial, I think exposing the corruption of asking for money to fund a legal defense and then not use it for that would have been politically damaging, which is really the only outcome I can see them going for in the first place with the trial.

They'll quickly counter anything Waters said because they're not super comparable.

"Let’s make sure we show up wherever we have to show up. And if you see anybody from that Cabinet in a restaurant, in a department store, at a gasoline station, you get out and you create a crowd. And you push back on them. And you tell them they’re not welcome anymore, anywhere"

Isn't the same as

"So we’re going to, we’re going to walk down Pennsylvania Avenue, I love Pennsylvania Avenue, and we’re going to the Capitol and we’re going to try and give … The Democrats are hopeless. They’re never voting for anything, not even one vote. But we’re going to try and give our Republicans, the weak ones, because the strong ones don’t need any of our help, we’re going to try and give them the kind of pride and boldness that they need to take back our country."

First, it's not about litigating this thing on the merits. It's all theater. Trump just needs to throw enough mud at the Democrats to give enough of an appearance that the impeachment is politically motivated. That provides sufficient cover for Republicans that want it.

Second, I would disagree that the two statements are not comparable. They were both insanely stupid comments to make. Also, neither is really a good basis for punishment.

I actually think Trump needs to be convicted but not of inciting the riot (absent some proof he was colluding with the leaders of the riot behind the scenes). I think he's far more culpable for his reaction to the riot. His refusal to take decisive action against it or even to come out and condemn it is far worse than statements he made before hand. Absent clear call for immediate unlawful action (which isn't there), the statements aren't enough. Sitting by until Pence had to save the day was inexcusable.
 
I spent 5 minutes watching Trump’s defense speak just now and it almost persuaded me by itself he should be convicted. These arguments suck.
