You can ask a cop to leave you alone if you're not committing a crime. My uncle was pulled over several times by the same cop while not committing a real infraction and threatened him with a harrassment complaint. Guess he should have been choked out.

that is them having a conversation and never once gave a reason for attempting to arrest him.

they are having a conversation about why he was stopped. he wasn't being arrested during the 1:15mark. they were sitting there talking and Garner is obviously tired of being harassed
then it turns into a cop grabbing him with a chokehold and the only thing anyone on the law side has said was that Garner was "suspicious of selling cigs"
never was there a time the cops said to stop talking and that you are under arrest for "whatever"

First time I've watched the full video. I had always thought the officer kept the choke hold on him after he said he couldn't breathe. I was under the assumption the chokehold was held for much longer than that. I also always believed that as long as you could talk then you could breathe ok, but maybe that's an old wives tale. I guess it is since the the man is dead.
But yeah looking at this video reasonably, I don't see anyway he could be charged with murder there. Manslaughter charge is iffy. But I doubt any chance he would have been convicted. I can see now why the grand jury did not indict him.
Now, I'm looking at this legally only. Do I think the police should remove chokehold takedowns if possible? Yes, and in fact supposedly NYPD already has a policy against this. But it's technically legal. My guess is that this will lead to chokehold's becoming illegal in the state of New York. And hey maybe it will also lead to more tasings and gun usage from police in New York!
